Darwin has served as lead counsel in several high profile cases. Darwin represented three Plaintiffs in a civil sexual harassment and assault case that involved the president of a national marketing company forcing himself on his employees. The case was successfully tried to a jury and settled on appeal for half a million dollars. Most notably, Darwin served as lead counsel in State of Utah v. Dale Gibbons, where he successfully defended Zions Bancorp’s chief financial officer against charges of felony drug and child endangerment charges.

He has also litigated civil rights claims, complex federal forfeiture cases, personal injury matters and various administrative law cases. He has tried seventeen cases to verdict and successfully argued thousands of motions before the state and federal courts.

Practice

Darwin’s focus is on civil litigation and motion practice.  His practice focuses on serious personal injury, wrongful death, civil rights, and contract disputes.  Before joining Jones & Swartz PLLC, he was the managing partner of a successful law firm in Salt Lake City, Utah for nine years.  He developed a reputation for obtaining favorable results in difficult cases.  He is currently representing clients throughout the states of Idaho and Utah.

Education

Darwin graduated as a William H. Leary Scholar from the University of Utah S.J. Quinney College of Law in 1997.   He was a staff writer for the Utah Law Review and on numerous occasions received recognition and awards for academic excellence in such areas of law as contracts, international human rights, judicial process and comparative law.  He earned his Bachelors of Science in Psychology and Writing in 1994 from the University of Utah.

Professional Standing & Affiliations

Darwin is licensed to practice in the state and federal courts of Idaho and Utah.   He has been a member of the Idaho State Bar Association and the Utah Bar Association since 1998.  He is a member of the Idaho Trial Lawyers Association, the American Bar Association, and the Idaho Criminal Bar Association.
